Definitions

3. What Personal Information We Collect

3.1 Information You Provide Directly

We collect the following categories of personal information you provide to us:

  • Account Information: First name, last name, email address, phone number, age, country/region/state, and other registration details
  • Health and Fitness Information: Height, weight, experience level, training frequency, equipment access, nutrition approach, cardio history, fitness goals
  • Progress Media: Photos and videos of your physical progress, body composition, and transformation content you submit to us
  • Communications: Messages, questions, and other content you send to us via SMS, email, or other channels
  • Payment Information: Billing details processed through Stripe, our payment processor. We do not store your full payment card information — this is handled securely by our payment processor
  • Testimonials and Media Releases: Content you provide for promotional use pursuant to a signed media release

3.2 Information We Collect Automatically

When you interact with our Services, we may automatically collect:

  • Device and technical information such as IP address, device type, operating system, and browser type
  • Usage data including how you interact with our Website and Services
  • SMS interaction data including message delivery status and response patterns
  • Geographic location data based on IP address, used to customize your experience

3.3 Sensitive Personal Information

We collect certain categories of sensitive personal information, including health data, body composition information, and progress photos and videos. We collect this information only when you voluntarily provide it as part of your coaching program. You are not required to provide sensitive information to use our Services, but certain features may be unavailable without it.

We will only process sensitive personal information with your explicit consent, as part of providing our Services to you, or as otherwise permitted by applicable law.

3.4 Biometric and Physical Characteristic Data

Progress photos and videos you submit may contain biometric data or information about your physical characteristics, including but not limited to body measurements, body composition, and physical features. If you are a resident of Illinois, Texas, Washington, or another state with biometric privacy laws:

  • Illinois residents: The Illinois Biometric Information Privacy Act (BIPA) may apply to certain biometric identifiers. We collect progress photos solely for the purpose of delivering coaching Services to you. We do not sell biometric data. We retain biometric-related information only for as long as necessary to fulfill the purpose for which it was collected, or as required by law, and will destroy it within three (3) years of your last interaction with us or when the purpose for collection has been satisfied, whichever comes first.
  • Texas residents: We collect biometric identifiers only with your consent, do not sell your biometric data, and will destroy it within a reasonable time after the purpose for collection has been satisfied.
  • Washington residents: We do not enroll biometric data into any commercial database and will not sell or disclose biometric data without your consent.

By submitting progress photos or videos to us, you consent to our collection and use of any biometric data or physical characteristic data contained therein solely for the purpose of providing and improving our coaching Services.

3.5 Information We Do Not Collect

If we become aware that we have inadvertently collected information from a minor, we will promptly delete it if requested by the minor (or their guardian).

  • Providing Services: To deliver coaching programs, SMS communications, personalized fitness and wellness content, and related Services
  • Charging for Services
  • Account Management: To create and manage your account, process payments, and communicate with you about your Subscription
  • Program Personalization: To customize your coaching program based on your health information, fitness goals, and progress data using automated and technology-assisted systems
  • Progress Analysis: To analyze progress photos and fitness data submitted by you as part of your coaching program, which may be processed through automated analysis tools
  • Automated Coaching Decisions: Our Website and/or Services use automated and technology-assisted systems to generate personalized coaching content, workout recommendations, and responses based on information you provide. These automated processes are informational in nature and do not constitute legally significant decisions about you but do affect the coaching content you receive.   • Communications: To send you coaching content, check-in reminders, program updates, and support communications via SMS and email
  • Marketing and Promotion: With your explicit consent via a signed media release, to use your transformation photos, videos, and testimonials for promotional purposes on social media and other channels
  • Safety and Security: To detect, prevent, and address fraud, security issues, and technical problems
  • Legal Compliance: To comply with applicable laws, regulations, and legal processes
  • Business Operations: To improve our Services, conduct internal analytics on aggregate and anonymized data, and operate our business
  • Business Transfers: In connection with a merger, acquisition, or sale of our business assets

We will not use your personal information for purposes materially different from those described in this Privacy Policy without providing you prior notice and, where required, obtaining your consent.

5. Legal Basis for Processing (Where Applicable)

6. How We Protect Your Personal Information

6.1 Security Measures

We implement industry-standard technical and organizational security measures to protect your personal information, including:

  • Encryption of data in transit using SSL/TLS technology
  • Secure hosting infrastructure through Railway and other industry-standard providers
  • Access controls limiting who within our organization can access your data
  • Regular security assessments of our systems and practices

No method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your personal information, we cannot guarantee absolute security. You acknowledge and accept this inherent risk.

Most U.S. states require notification within 30 to 72 hours of discovering a breach. We will notify affected users by email and, where required by law, will notify relevant regulatory authorities. 6.3 Data Retention

Upon cancellation or termination of your Subscription, we may retain your data for up to twelve (12) months for administrative, legal, and compliance purposes, after which it will be securely deleted or anonymized. You may request earlier deletion by contacting us at joinreign@gmail.com, subject to any legal obligations we may have to retain certain records.

Progress photos, health information, biometric data, and other sensitive data submitted during your program will be retained for the duration of your Subscription plus the retention period described above unless you request earlier deletion.

7. Where We Store and Transfer Your Data

The Company is based in the United States. Your personal information is stored and processed on servers located in the United States, primarily through our hosting provider Railway.

If you access our Services from outside the United States, please be aware that your personal information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your country. By using our Services, you consent to this transfer.

We take reasonable measures to ensure that your personal information is protected regardless of where it is processed, including through contractual arrangements with our service providers.

8. Who We Share Your Personal Information With

We do not sell your personal information to third parties. We may share your personal information with the following categories of recipients:

8.1 Service Providers

We share personal information with third-party service providers who assist us in operating our business and delivering our Services, including:

  • Payment processing: Stripe, Inc. for secure payment processing
  • SMS delivery: Twilio Inc. for SMS communication services
  • Database and storage: Supabase for database and data storage services
  • Backend hosting: Railway for backend infrastructure and hosting
  • Frontend hosting: Vercel for frontend hosting and content delivery
  • Processing: Anthropic, PBC for processing and delivering information
  • Analytics: Google LLC for website analytics via Google Analytics
  • Legal, accounting, and professional services providers

All service providers are contractually required to protect your personal information and use it only for the purposes for which it was disclosed.

By using the Services, you also authorize the engagement of these third parties as sub-processors of your data. If you object to the sub-processors' handling of your data on the terms indicated on their sites, please terminate your use of the Services.

8.2 Marketing and Promotional Use

We will only share your name, likeness, transformation photos, videos, or testimonials for marketing or promotional purposes if you have signed a separate Media Release and Right of Publicity Waiver. Without a signed release, we will not use your personal media for promotional purposes.

8.3 Legal Requirements

We may disclose your personal information to law enforcement agencies, government authorities, courts, or other third parties when we believe in good faith that disclosure is required by law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of our company, our users, or the public.

8.4 Business Transfers

In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of our assets, your personal information may be transferred to the successor entity, subject to confidentiality obligations. We will notify you of any such transfer via email or prominent notice on our Website.

8.5 With Your Consent

We may share your personal information with other third parties when you have provided your explicit consent to do so.

9. Not a HIPAA Covered Entity

The Company is not a "covered entity" or "business associate" as defined under the Health Insurance Portability and Accountability Act of 1996 ("HIPAA") or its implementing regulations. Our Services do not constitute healthcare services and are not subject to HIPAA. While we take reasonable steps to protect health-related information you share with us, HIPAA's protections do not apply. By submitting health-related information, you acknowledge and accept this limitation.

10. SMS Communications and TCPA Compliance

By purchasing our Services and providing your phone number, you expressly consent to receive recurring automated text messages (SMS) from the Company at the phone number you provided, including coaching program content, check-in reminders, and support communications. This consent is not a condition of purchase.

TCPA Disclosure: Our SMS communications are sent using automated technology. You have consented to receive these messages by agreeing to our Terms and Conditions and providing your phone number. Message frequency varies based on your program. Message and data rates may apply.

To opt out of SMS communications at any time, reply STOP to any message. After opting out, you will receive one final confirmation message. You may opt back in at any time by replying START. For help, reply HELP to any message or contact us at joinreign@gmail.com. Opting out of SMS communications may limit or terminate your ability to receive our Services.

We collect and process data related to your SMS interactions, including message content, delivery status, and response patterns, solely for the purpose of delivering and improving our coaching Services. SMS message content and coaching communications delivered through our Services and/or Website may be generated or facilitated through automated or technology-assisted means. We do not share the content of your SMS coaching communications with third parties except as required to deliver the service (including Twilio as our SMS provider) or as required by law.

11. Automated Decision Making and Profiling

Our Services and/or Website use automated and technology-assisted systems to deliver personalized coaching content, generate program recommendations, and facilitate communications. These automated systems process information you provide, including your health data, fitness goals, and progress submissions, to customize the coaching content you receive.

These automated processes are used to enhance and deliver our Services and do not constitute automated decision-making that produces legal or similarly significant effects on you as defined under applicable law. We do not use your personal information for automated decision-making that determines your eligibility for credit, employment, insurance, or similar significant matters.

12. Your Privacy Rights and Choices

12.1 General Rights

Depending on your location, you may have the following rights regarding your personal information:

  • Correction: Request that we correct inaccurate or incomplete personal information
  • Deletion: Request that we delete your personal information, subject to certain exceptions

Categories of personal information collected for CCPA purposes: Identifiers, health and medical information, biometric information, commercial information, internet and network activity, sensory data (photos, audio, video), and inferences drawn from the above.

We will respond to verifiable consumer requests within the time period required by applicable law, which is currently 45 days under the CCPA, extendable by an additional 45 days when reasonably necessary with notice to you. The response period begins only upon receipt of a complete verifiable request including sufficient proof of identity. You may submit a request twice per 12-month period. We reserve the right to deny or decline to respond to requests that are incomplete, unverifiable, excessive, or not required by applicable law.

12.3 Other U.S. State Privacy Rights

Residents of Colorado, Connecticut, Virginia, Utah, Oregon, Texas, Montana, and other states with applicable consumer privacy laws have rights similar to those described above, including rights to access, correct, delete, and opt out of certain processing. We will respond to verifiable requests from residents of these states in accordance with applicable law.

We will not charge a fee for reasonable requests but reserve the right to charge a reasonable fee for excessive, repetitive, or manifestly unfounded requests.

Our primary Services are delivered via SMS and do not rely heavily on cookies. Our Website at strongvampirex.com may use cookies and similar tracking technologies to improve your experience and analyze how our Website is used.

You can control cookies through your browser settings. Disabling cookies may affect the functionality of certain parts of our Website.

We may use third-party analytics services that collect information about your use of our Website. These services have their own privacy policies governing their use of your information.

We do not currently respond to Do Not Track (DNT) signals from browsers. If we change this practice, we will update this Privacy Policy.

Users who visit the Website and have JavaScript enabled are tracked through Google Analytics. Google Analytics collects information anonymously and reports website trends to us without identifying individual visitors. Our payment processing is handled by Stripe, Inc., subject to Stripe's privacy policy at stripe.com/privacy. Our SMS delivery is powered by Twilio Inc., subject to Twilio's privacy policy at twilio.com/legal/privacy.

15. Children's Privacy

Our Services are not directed to individuals under the age of 18. We do not knowingly collect personal information from minors. If we become aware that we have collected personal information from someone under 18 without verifiable parental consent, we will take steps to delete that information promptly and terminate the minor's account without refund. 16. Limitation of Liability for Privacy Claims

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THIS PRIVACY POLICY OR OUR PRIVACY PRACTICES SHALL BE LIMITED AS SET FORTH IN THE LIMITATION OF LIABILITY SECTION OF OUR TERMS AND CONDITIONS, WHICH ARE INCORPORATED HEREIN BY REFERENCE. 18.4 Special Category Data

Health data, body composition information, and progress photos constitute special category data under GDPR Article 9. We process this data only with your explicit consent under Article 9(2)(a). You may withdraw this consent at any time, though doing so may prevent us from delivering the Services.

18.5 Your GDPR Rights

As an EEA, UK, or Swiss resident, you have the following rights under GDPR: (a) Right of Access; (b) Right to Rectification; (c) Right to Erasure; (d) Right to Restriction; (e) Right to Data Portability; (f) Right to Object; (g) Right to Withdraw Consent; and (h) Right to Lodge a Complaint with your local supervisory authority. 18.6 International Data Transfers

Your personal data may be transferred to and processed in the United States, which may not provide the same level of data protection as your home country. 18.7 Data Retention for EEA/UK Users

For EEA and UK residents, we apply the following retention periods: active Subscription data is retained for the duration of your Subscription; post-cancellation data is retained for up to 12 months; financial and billing records are retained for 7 years as required by law; and data subject to a legal hold or dispute is retained until resolution.

18.8 Data Breach Notification for EEA/UK Users

In the event of a personal data breach affecting EEA or UK residents, we will notify the relevant supervisory authority within 72 hours of becoming aware of the breach where required by GDPR Article 33, and will notify affected individuals without undue delay where the breach is likely to result in a high risk to their rights and freedoms under GDPR Article 34.
